Terms and Conditions for Participation in Heart&Soul Experience (“Terms of Participation”)

1. In exchange for your participation in the Heart&Soul Experience (“Experience”), you agree to be bound and abide by these Terms of Participation, as well as all other policies, terms and conditions applicable to the Experience and made known to you by the Organisers and Promoters (“Experience Policies”). All Experience Policies (such as the Admissions Policy, Booking Policy, Ticket Terms and Conditions and General FAQs) shall be considered part of these Terms of Participation. By registering for or otherwise participating in the Experience, you indicate your acceptance of these Terms of Participation.

2. These Terms of Participation are drafted in English and translated to Chinese, Malay and Tamil. In the event of any inconsistency or discrepancy between the English version and the translated versions(s), the English version shall take precedence. 

3. Where you submit a group registration for yourself and/or other persons, you confirm that you are duly authorised to do so as their agent. You agree, on your own behalf and as agent on behalf of all persons for whom you are registering, to be bound by these Terms of Participation. Accordingly, references herein to “you”, “your” and the like, shall mean each person who is registered for or otherwise participates in the Experience.

4. You confirm that you are at least 18 years of age. If you are a minor under the age of 18, you confirm that you have obtained your parent’s or legal guardian’s consent to participate in the Experience on these Terms of Participation. If you are registering for the Experience on behalf of a minor, you confirm and agree that you are registering for the minor with full authority as, or as agent on behalf of, the parent or legal guardian of the minor, and that the minor’s parent or legal guardian has consented to his/her participation in the Experience on these Terms of Participation.

5. The Experience is organised by the Ministry of Digital Development and Information (“MDDI”) and the National Library Board (“NLB”) (collectively, the “Organisers”). The Organisers have appointed third party suppliers to operate, manage, produce and promote the Experience (the “Promoters”). References herein to “we”, “us” or “our” shall mean “the Organisers and/or Promoters”.

6. We may add to, delete or modify these Terms of Participation at any time without notice to you. The most current version of the Terms of Participation can be found at heartandsoul.gov.sg/terms-of-participation.

7. All registrations for participation in the Experience are subject to availability of tickets. We reserve the right to refuse any registrations received for any reason. By submitting your registration and/or participating in the Experience, you agree to these Terms of Participation.

8. We reserve the right to postpone, cancel, interrupt or stop the Experience, or make any other changes to the Experience (including changes to venue/platform, programmes, dates, times or audience capacity), at any time, without prior notice and without any liability to you, save that we will publish a publicity notice in respect of any postponement or cancellation of the Experience.

9. By registering for or otherwise participating in the Experience, you agree and consent to:

   1. the terms of the Experience privacy policy as amended from time to time, the most recent version being reflected at heartandsoul.gov.sg/privacy-statement (“Privacy Policy”), which shall apply to your registration for and participation in the Experience. In the event of conflict, the provisions of these Terms of Participation shall prevail over the provisions of the Privacy Policy; and

   2. subject to and save as otherwise provided herein, the Organisers and Promoters, as well as our representatives, agents, suppliers and sponsors, collecting, using, disclosing and processing your personal data, for purposes related to the Experience, such as communications, publicity and/or promotions connected to the Experience, as well as enhancement of participants’ experience at the Experience. The Experience Policies may set out specific purposes of use in respect of specific personal data (“Specific Use Provisions”). In such a case, the Specific Use Provisions will take precedence over these Terms of Participation in respect of any conflict.

10. Photographs, audio, video and other recordings may be taken of the Experience and Experience participants. By participating in the Experience, you grant the Organisers and Promoters, as well as our respective representatives, agents, suppliers and sponsors, permission to collect, use and disclose any such photographs or audio-video or other recordings of you (“Audio-Visual Materials”), for security and publicity/promotional purposes (whether for the Experience or otherwise) and without further notification, remuneration or compensation to you.

11. By registering for and/or participating in the Experience, you further agree that:

    1. the copyright and all other intellectual property rights in and to all Audio-Visual Materials shall vest solely and absolutely in MDDI without further compensation; and

    2. as applicable and to the maximum extent permissible under law, you hereby waive your moral rights in and to all Audio-Visual Materials in favour of MDDI.

12. If, in connection with your submission of a group registration for the Experience, you provide the personal data of any other person(s), you warrant and represent that such other person(s) have also consented to the collection, use and disclosure of their personal data in accordance with these Terms of Participation.

13. Entry/access to the Experience venue may be subject to the venue owner’s prevailing terms and conditions of entry. You may be asked to produce your valid photo ID (NRIC, Passport, or Driver’s License) for inspection before being granted admission to the Experience.

14. You must comply with all signs, notices, directions, instructions or requests of the Organisers and Promoters and our representatives, agents and suppliers, in connection with the Experience. We reserve the right, directly or through our representatives, agents or suppliers, to refuse admission to any person(s) or remove any person(s) from the Experience (including any person(s) whose conduct is disorderly or inappropriate or who poses a threat to security, or to the enjoyment of the Experience by others). You must ensure that participants who are less than 12 years of age are supervised by a responsible adult.

15. The use of photographic equipment by you is allowed for private non-commercial purposes only. All other recording and any transmission by you of the Experience is prohibited, including (without limitation) taking of photographs and recording of any data or information relating to the Experience and any other participant. Flash photography and use of tripods and selfie-sticks are not permitted.

16. The Organisers and Promoters, and our representatives, agents, suppliers and sponsors, shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death in connection with your registration for or participation in the Experience, or any postponement, cancellation or any other changes made by us to the Experience, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

17. In the event of any breach of these Terms of Participation by you, or any act or omission by you which results in such a breach, you shall indemnify, keep indemnified and hold the Organisers and Promoters harmless from and against all actions, proceedings, claims, demands, loss, damages, costs, legal costs and other expenses of any nature which may be made or brought against or suffered or incurred by the Organisers/Promoters, whether directly or indirectly.

18. These Terms of Participation are governed by the laws of the Republic of Singapore, and you agree to submit to the non-exclusive jurisdiction of the Singapore courts.

19. In connection with your access to and use of the Heart&Soul ticketing website (app.heartandsoul.gov.sg) and/or the Boarding Kiosk(s) located at the Experience venue (collectively, the “Platform”), you acknowledge and agree that:

    1. You are solely responsible for any data/content (including personal data) that you post, communicate, create, generate or otherwise make available on or through the Platform and/or in the course of accessing/using the GenAI Features (as defined below) (collectively, “Your Content”). Your Content may be used by us for purposes related to the Experience;

    2. Your Content and the content of other participants, is not monitored by the Organisers or Promoters. We do not pre-screen nor do we exercise editorial control over any such content, and are not responsible for the same. We may however, in our sole discretion, screen, delete and/or remove any content made available by any participant (including yourself) if we receive a complaint from other participants or a notice of intellectual property infringement or other legal instruction for removal, or which in our sole and absolute opinion violates these Terms of Participation, or is otherwise illegal or objectionable, or any other reason as we may see fit. We may use automated systems that analyse any content to help detect infringement and abuse, such as spam, malware and illegal content; and

    3. You will not post, communicate, create or otherwise make available on the Platform any content that:

       1. is or may be unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, racially, religiously, ethnically or otherwise objectionable, untrue or irrelevant to the Experience; or

       2. infringes the copyright or any other intellectual property rights of any other person.

    4. We may also block access by you or other participants to the Platform, as part of our effort in protecting the Experience or other participants, or otherwise enforcing the provisions of these Terms of Participation, without any refund or compensation.

20. In connection with the Generative AI features and experiences available at the Experience and/or on the Platform (collectively, the “GenAI Features”), and without prejudice to the other Terms of Participation, you acknowledge and agree that:

    1. Your Content may be processed by our Generative AI systems, as relevant, for the Experience;

    2. the GenAI Features are provided primarily for entertainment and educational purposes, and any content, scenarios, or responses generated or made available to you through the GenAI Features should not be relied upon for making any personal or professional decisions; and

    3. the Organisers and Promoters make no representations or warranties regarding the accuracy, reliability, or appropriateness of any content, scenarios, or responses generated or made available to you through the GenAI Features, and shall not be liable for any consequences arising from your use of or reliance on the same.

21. In the event of any inconsistency between the provisions of the Experience Policies and these Terms of Participation, these Terms of Participation shall take precedence to the extent of such inconsistency. For purposes of this clause only, the Experience Policies shall not be treated as part of these Terms of Participation.
